1. PROMOTION DATES. These rules (the “Official Rules”) govern the 2017 - 94.5 KTI COUNTRY “CMA Flyaway” presented by Warner Music Nashville (“Promotion”) which will begin on September 11, 2017 at 12:01 a.m. CT and end on September 22, 2017 at 7:00 p.m. CT.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal U.S. residents who reside in Wisconsin and who are 18 years of age or older at the time of entry. Employees of Scripps Media, Inc., d/b/a WKTI FM (the “Promoter” or “Station”), Warner Music Nashville, subsidiaries, and affiliated entities, and of any advertising agencies, participating sponsors, promotional partners, or other entities involved with this Promotion, or of any other broadcasting stations in the Milwaukee metropolitan area, and the members of the immediate families (spouse, parents, siblings or children) or households (whether related or not) of the foregoing individuals are ineligible to participate or win. Void where prohibited and outside Wisconsin.
b. Only one winner per household is permitted in any Promoter promotion. Specifically for “CMA Flyaway” only one qualifier per household is allowed. In addition, individuals may win a Promoter promotion only once every 60 days, and once every six months for prizes valued over $600.
c. Entrants are required to provide truthful information, and Promoter will reject and delete any entry that it discovers to be false or fraudulent. Promoter will disqualify any entry from individuals who do not meet the eligibility requirements, and Promoter will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act and as otherwise required by law.
a. To participate in the Promotion, you may enter via the following methods:
VIA LIVE ON-AIR ENTRY - For a chance to qualify, listen to 94.5 KTI COUNTRY weekdays from September 11, 2017 – September 22, 2017 for the cue to call at 7 a.m. 11 a.m. 1 p.m. and 4 p.m.
Each day, listeners will be invited to call in as a designated numbered caller. The correct caller number may change daily. The correct numbered caller will be designated as the finalist upon verification of contest eligibility. All finalists will need to attend the 94.5 KTI COUNTRY and Hunger Task Force End of Summer – End Hunger party on September 22, 2017 from 5 p.m. to 9 p.m. at the Hunger Task Force Farm located at 9000 S. 68th St. Franklin, WI 53132. Reverse drawing for qualifiers will take place during this event. 94.5 KTI COUNTRY reserves the right to alter the days of contest play.
b. The odds of being selected as a qualifier depends on the number of contestants competing to be the correct numbered caller for each contest episode. Limit one qualifier per household.
c. Finalists must execute and return any required affidavit of eligibility and/or liability/publicity release and/or travel releases for themselves and their traveling partner prior to being designated the Grand Prize Winner and winning the Grand Prize.
4. GRAND PRIZE
a. Winner will receive a prize package for two the 2017 CMA Awards in Nashville, TN. In all cases, the package includes two tickets to the ceremony, hotel accommodations, and airfare.
b. All prizes are non-transferable and cannot be exchanged for other prize/merchandise/cash. Winner is responsible for any taxes and additional costs not described as prize. As required by the IRS, if the prize value exceeds $599, the winner will receive a 1099 tax form at the end of the year. The IRS does require the winner to report and file the 1099 with their tax return.
c. The Grand Prize is provided as is. Neither Promoter nor Warner Music Nashville has made or is responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Grand Prize.
d. The Grand Prize is expressly limited to the item(s) listed above and does not include taxes, gratuities or any other expenses. Promoter is not responsible for winner’s limitations that prevent acceptance, use, or nonuse of Grand Prize.
e. The decision of the judges (promoter) is final.
f. 94.5 KTI COUNTRY reserves the right to end this promotion or vary prizes at any time without prior notice
5. GRAND PRIZE WINNER SELECTION
a. All Finalists must be at the Grand Prize Giveaway Event and “checked-in” with Promoter staff, including a showing of valid government-issued ID, no later than 7:00 p.m. CT on September 22nd, 2017. Any Finalist not at the Grand Prize Giveaway Event and checked in with the Promoter by that time will be immediately disqualified and will not have the opportunity to win the Grand Prize. No substitute will be selected for any such Finalists who are not properly checked-in at the Grand Prize Giveaway Event. Finalists must be present in person to win and may not send a substitute or representative in their place.
b. At the Grand Prize Giveaway Event, Promoter will do a random reverse drawing from the present, checked-in and finalists that meet the eligibility rules. For example, if all 50 finalists matched the qualifications, all names would be put into a receptacle. A name would be pulled from the box and that finalist would be eliminated from contention. One by one finalists would be drawn and eliminated. The last name in the box would be designated the grand prize winner.
c. The last finalist, subject to verification of eligibility and compliance with the terms of these Official Rules will be designated the grand prize winner.
d. The potential Grand Prize winner will be required to execute and return an affidavit of eligibility and liability release and publicity release and provide required tax forms within three days of date of Grand Prize Giveaway Event. If winner is not compliant with these Official Rules, as determined by Promoter in its sole discretion, if winner declines the Grand Prize for any reason, or if winner does not provide required identification or required documents by the deadlines set forth herein, then such winner may be disqualified and, at Promoter’s discretion an alternate winner may be designated from the runners-up in the contest. The second to last finalist would be eligible to win. If the second to last Finalist declines or is not eligible for the Grand Prize, the third to last Finalist will have the option to accept the Grand Prize. If that winner declines the Grand Prize or is not eligible, WKTI will randomly select a Finalist from all other checked-in and eligible finalists who attended the grand prize event. If no Finalist accepts the Grand Prize, the Promotion will end.
e. Under no circumstances will more than one grand prize be awarded. If more than one Finalist appears to have won the Grand Prize, the Grand Prize winner will be randomly selected from among such Finalists.
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. Winner will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more.
b. Participating in the Promotion and acceptance of Grand Prize constitutes each entrant’s and winner’s (and guest’s where applicable) permission for the Promoter or its agents to photograph, film, record that entrant or winner and to use his or her name, city, state, voice, or likeness, and any statements made by him or her regarding the Promotion or Promoter for purposes of trade, publicity or promotion without additional financial or other compensation.
c. Prior to awarding the Grand Prize, and depending on the nature of the Grand Prize and eligibility requirements of the Promotion, the Promoter in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By entering, participating and/or accepting Grand Prize, each entrant and winner agrees not to sue and to release, discharge, indemnify, hold harmless, and absolve the Promoter, Warner Music Nashville, the Promotion sponsors and promotional partners and advertising and promotion agencies and each of their respective parent, subsidiary and affiliated entities and the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the Grand Prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of Grand Prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery. Except where prohibited, by entering the Promotion, each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or Grand Prize must be resolved individually, without resort to any form of class action, and the state or federal courts situated in Milwaukee, WI; (ii) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event shall such costs include attorneys’ fees; and (iii) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded (collectively, “Special Damages”). Further, by entering the Promotion, each entrant waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
d. Promoter, in its sole discretion, reserves the right to disqualify any person (and all of that person’s entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or is otherwise in violation of the Official Rules or direction of Promoter. All decisions of Promoter management with respect to the Promotion are final. If a dispute arises regarding compliance with these Official Rules, Promoter may consider, in its sole discretion, data reasonably available to Promoter through information technology systems in Promoter’s control, but Promoter will not be obligated to consider any data or other information collected from any other source. Promoter further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the online entry portion of the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoter in is sole discretion. Promoter will post notice of its action on the Promotion website. Promoter’s failure to enforce any term of these Official Rules will not constitute a waiver of this provision. If there is any conflict between the terms of these Official Rules and any marketing or entry materials used in connection with the Promotion, the terms of the Official Rules will govern. If due to circumstances beyond the control of Promoter, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Promoter reserves the right, but not the obligation, to modify, suspend, or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of the Grand Prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (iii) lost, stolen, mangled, misdelivered, misdirected, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of the Grand Prize that cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or the name of the winner following completion of the Promotion (CMA Flyaway), send a self-addressed, stamped envelope specifying “Official Rules” or “Winner List” to WKTI “CMA Flyaway” or Official Rules Request 94.5 KTI COUNTRY, 720 E. Capitol Drive, Milwaukee, WI 53212. A copy of the Official Rules is also available during regular business hours at 620 WTMJ, 720 E. Capitol Drive, Milwaukee, WI 53212. All such requests must be received within 60 days following completion of the Promotion.
