1. PROMOTION DATES. These rules (the “Official Rules”) govern the 2017 KTI COUNTRY “9 to Noon Cash Baboon” (“Promotion”) which will begin on March 20, 2017 at 5:01 a.m. CT and end on May 26, 2017 at 1:00 p.m. CT.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal U.S. residents who reside in Wisconsin and who are 18 years of age or older at the time of entry. Employees of Scripps Media, Inc., d/b/a WKTI-FM (the “Promoter” or “Station”) and their respective corporate parents, subsidiaries, and affiliated entities, and of any advertising agencies, participating sponsors, promotional partners, or other entities involved with this Promotion, or of any other broadcasting stations in the Milwaukee metropolitan area, and the members of the immediate families (spouse, parents, siblings or children) or households (whether related or not) of the foregoing individuals are ineligible to participate or win. Void where prohibited and outside Wisconsin.
b. Only one winner per household is permitted in any Promoter promotion. In addition, individuals may win a Promoter promotion only once every 60 days, and once every six months for prizes valued over $600.
c. Entrants are required to provide truthful information, and Promoter will reject and delete any entry that it discovers to be false or fraudulent. Promoter will disqualify any entry from individuals who do not meet the eligibility requirements, and Promoter will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act and as otherwise required by law.
3. ENTRY and Winner Selection
a. To participate in the Promotion, you may enter via the following methods:
VIA ON-AIR SOLICIT – There will be up to 50 on-air qualifying segments between March 20 and May 26, 2017 administered by 94.5 KTI COUNTRY (the “Events”). In order to enter the Promotion, listeners will be required to listen to 94.5 KTI COUNTRY. During a qualifying segment, the station will play an on-air cue to call in the form of a “Cash Baboon cue to call announcement.” When the “Cash Baboon cue to call announcement” is played contestants will need to dial (414) 799-9494. The twentieth (20th) caller that meets all eligibility requirements will be designated the winner of that segment.
b. The odds of being selected as caller 20 depends on the number of calls during each on-air solicit episode. Limit one prize winner per household for the duration of the contest. Each entrant may only win one time.
c. The winner must execute completely a required affidavit of eligibility, liability/publicity release and a W-9 tax form within thirty days of the date selected. Failure to complete paperwork within the 30-day time frame will result in the disqualification of the winner.
a. Eligible winners that have completed the required paperwork will be awarded one (1) check for $500. Check processing could take up to six (6) weeks from the completion of eligibility and tax paperwork.
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. Winner will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any cash prize or any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more.
b. Participating in the Promotion and acceptance of Prize constitutes each entrant’s and winner’s (and guest’s where applicable) permission for the Promoter or its agents to photograph, film, record that entrant or winner and to use his or her name, city, state, voice, or likeness, and any statements made by him or her regarding the Promotion or Promoter for purposes of trade, publicity or promotion without additional financial or other compensation.
c. Prior to awarding the prize, and depending on the nature of the prize and eligibility requirements of the Promotion, the Promoter in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By entering, participating and/or accepting Grand Prize, each entrant and winner agrees not to sue and to release, discharge, indemnify, hold harmless, and absolve the Promoter, the Promotion sponsors and promotional partners and advertising and promotion agencies and each of their respective parent, subsidiary and affiliated entities and the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the Grand Prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of Grand Prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery. Except where prohibited, by entering the Promotion, each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or Grand Prize must be resolved individually, without resort to any form of class action, and the state or federal courts situated in Milwaukee, WI; (ii) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event shall such costs include attorneys’ fees; and (iii) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded (collectively, “Special Damages”). Further, by entering the Promotion, each entrant waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
d. Promoter, in its sole discretion, reserves the right to disqualify any person (and all of that person’s entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or is otherwise in violation of the Official Rules or direction of Promoter. All decisions of Promoter management with respect to the Promotion are final. If a dispute arises regarding compliance with these Official Rules, Promoter may consider, in its sole discretion, data reasonably available to Promoter through information technology systems in Promoter’s control, but Promoter will not be obligated to consider any data or other information collected from any other source. Promoter further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Internet portion of the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoter in is sole discretion. If Promoter terminates the Internet portion of the Promotion, Promoter will select remaining Semi-Finalists by random drawing from among all eligible, non-suspect, non-winning online entries received prior to the termination of the Internet portion of the Promotion. Promoter will post notice of its action on the Promotion website. Promoter’s failure to enforce any term of these Official Rules will not constitute a waiver of this provision. If there is any conflict between the terms of these Official Rules and any marketing or entry materials used in connection with the Promotion, the terms of the Official Rules will govern. If due to circumstances beyond the control of Promoter, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Promoter reserves the right, but not the obligation, to modify, suspend, or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of the Grand Prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (iii) lost, stolen, mangled, misdelivered, misdirected, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of the Grand Prize that cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or the name of the winner following completion of the Promotion (9 to Noon Cash Baboon), send a self-addressed, stamped envelope specifying “Official Rules” or “Winner List” to KTI COUNTRY Winner List or Official Rules Request, KTI COUNTRY, 720 E. Capitol Drive, Milwaukee, WI 53212. A copy of the Official Rules is also available during regular business hours at KTI COUNTRY, 720 E. Capitol Drive, Milwaukee, WI 53212. All such requests must be received within 30 days following completion of the Promotion.
